This course is similar to 712 Negotiation except that it will emphasize the ethical issues that arise in legal negotiations. Students will conduct a series of mock negotiations in civil and criminal settings, such as family law, labor law, commercial law, and plea bargaining. Students will draft negotiation plans, contracts and other settlement agreements, and outcome analyses. The materials comprise writings by lawyers, psychologists, and ethicists, plus the Model Rules of Professional Responsibility, commentary on the Rules, and the decisions of state ethics boards and appellate courts.
