The Internet has become an indispensable feature of contemporary social, cultural, political, and intellectual life. It’s also become the battleground for many of our most compelling legal disputes. This course addresses some of the critical issues facing Internet companies, users, and regulators. We will pay special attention to the fights over online copyright infringement from Napster to YouTube, the liability of intermediary services (like search engines) for illegal material that they host or make accessible, free speech, privacy, government surveillance, and “net neutrality.” Along the way, we’ll pay attention to the cross-border struggle between competing legal systems for control over the Internet and the rules that govern it. While our main focus will be doctrinal, we will also consider the theoretical and public policy debates that inform the way that lawyers, judges, and government officials think about these issues.
