This course will examine a number of issues at the intersection between law and medicine. It will consider, for example, the nature of the doctor-patient relationship, the legal remedies for medical malpractice, the duty of informed consent, the locus of responsibility for making medical decisions, the definition of death, the way medical decisions for children and incompetent adults should be made , the usefulness of advance directives, the prohibition of physician-assisted suicide, the bureaucratization of medical care, the extent to which religious belief should excuse parents from providing their children conventional medical care, and the law’s role in regulating organ transplants. The reading will include the kinds of materials conventionally found in casebooks as well as supplementary material from books and journals.
