Through the writings of legal scholars and social science researchers, this course examines the functions of juries and their competence to perform these functions. First, legal analyses of the jury (including Supreme Court decisions) are compared with social science research on such topics as: jury size, representativeness, decision rules, individual and group decision-making processes, the comprehension of judicial instructions, and fairness. Second, trial attorneys’ strategies for the selection and persuasion of juries are analyzed from a psychological perspective. Two to three weeks of the course are devoted to topics suggested by the students.
