High stakes litigation matters raise complicated and unique issues, especially in the discovery phase, where the lawyers spend most of their time and the case is either won or lost. In recent years, modern discovery practices have emerged to change how litigators represent their clients, and how judges expect the parties and counsel to achieve compliance with discovery requirements.
This seminar will focus on how litigators should address the major themes of discovery, using the tools provided in the Federal Rules of Civil Procedure, in pharmaceutical class action, toxic tort, white collar, copyright and trademark and antitrust litigation. In addition to lectures from the instructor, who has managed discovery in high stakes litigation for more than 25 years, and class discussions, students will explore cutting edge issues with judges and practitioners who were involved directly in the cases assigned for reading. This will allow us to appreciate and analyze the considerations and issues that drove the cases behind the scenes.
