Say a person convicted of a serious crime is later exonerated. What are the civil implications of that exoneration, if any? This seminar will use this question as a focal point for examining larger questions of sovereign immunity, official immunity, section 1983 litigation, Bivens litigation, and also legal malpractice. The seminar will provide an introduction to each of those issues. It will also consider what civil causes of action a wrongfully convicted person might have. We will consult major Supreme Court cases, legal-academic articles, and pleadings of actual cases. Student participation required.
