Taught by an experienced voting rights litigator, this seminar examines the theory and practice of bringing statutory voting rights claims in the federal courts. We will explore pending and recent cases brought under the Voting Rights Act, the National Voter Registration Act, the Uniformed and Overseas Citizens Absentee Voting Act, and the materiality provision of the Civil Rights Act of 1964. The course will focus not only on the substantive provisions of these federal statutes, but equally on the lifecycle of actually litigating a voting rights case, from complaint and trial through appellate and potential Supreme Court review. We will examine the parties? pleadings and briefs, district court and appellate court decisions, and recordings of recent oral arguments, with attention given to identifying and understanding questions of litigation strategy.
