Artificial Intelligence: Liability, Insurance, and Regulation
This seminar examines how society should regulate the risks of harm that artificial intelligence creates. We will study proposals for direct agency-based regulation and discuss what an AI regulator would — and should — do. However, given that U.S. lawmakers seem in no hurry to adopt a direct regulatory regime for AI, our primary focus will be on the role played by liability law (and liability insurance) as a system of AI risk regulation. The harms we will address include personal injury and property damage caused by autonomous vehicles, personal injury caused by medical AI, financial losses caused by LLM-enhanced robo-advisors, and the psychic harms attributed to social media platforms.
