There is an extensive literature which seeks to explain and rationalize the historical development of modern tort law. The source material on which this theorizing is based mainly dates from the nineteenth and early twentieth century, but includes much earlier material (for example the Case of the Thorns of 1466). In this seminar we shall engage in cooperative research, investigating the various explanatory theories which have been advanved - for example the thesis that the historical process was driven by economic forces, or that the legal doctrines evolved to subsidize economic growth. More generally we shall consider the general problem of explanation with regard to the evolution of private law. Sutdents will present papers and lead discussion on selected topics, and be expected to engage in limited but original research.
